MAY 2009: I AM RECEIVING EMAILS AND COMMENTS FROM THE NETHERLANDS, NORWAY, AND SWEDEN ABOUT PLATTE RELATING TO CLAIMS OF UNEXPLAINED POPUP BILLS AND SUBSCRIPTIONS TO SEVERAL PLATTE PORN MOVIE WEBSITES. THE FOLLOWING INFORMATION MAY HELP:

A NEWS REPORT today (18 May 2009. 11.00am) says the Norwegian Consumer Council is trying to put a stop to Platte International’s activities. See this translation.  “In our opinion the procedure is illegal and erroneous bills related and we have pointed out to the company. Platte har derimot signalisert at de ikke ønsker å følge våre pålegg. Platte has however indicated that they do not want to follow our orders. I og med at selskapet holder til på De britiske jomfruøyene er det vanskelig for oss å kunne gripe inn med sanksjoner. Since the company is located in the British Virgin Islands, it is difficult for us to intervene with sanctions. Vi har derfor valgt å kontakte Google som formidlet annonsene og banken som ble benyttet for innbetaling til selskapet, sier seksjonssjef Frode Elton Haug i Forbrukerombudet. We have therefore decided to contact Google as communicated ads and the bank that was used for payment to the company, “says Director Frode Elton Haug in the Consumer. (translation by Google). 21 May 2009: I have written a piece in today’s Guardian newspaper on the Norwegian action against Platte – Norway pops porn biller Platte out of the picture.

Trend Micro’s free online scanner, HouseCall, detects and removes Platte International software.

However, I may no longer respond to e-mails if you are asking for advice that you could have very easily read here. 3 April 2008: Jack Schofield’s Ask Jack column – popup bills rise again – has now picked up reader comments on the new popup bills. I saw this short piece a couple of days ago when the section was being put together. It reminded me of Ask Jack in February 2007 when Guardian reader Ted Kenyon kicked off our lengthy investigations into Micro Bill Systems. We are, as they say, most definitely back on the case. The original information from March 2008 follows:

Platte International Ltd is a new company using the MBS ‘popup’ billing technology. Platte Media is the operating division of Platte International Ltd. The new websites are plattemedia.com and getfilmsnow.com. (added October: and movierecall.com – warning: porn images).

When and how did Platte get into your system? There are a series of helpful questions here including a link for instructions to run the Internet Explorer History View (IEHV) program. Remember that the popup bill appears on the fourth day (e.g. sign up on Monday, popup bill on Thursday). What day and time did Platte install? A quick way to find out is to right click/properties/general on the Platte desktop icons – check the created date/time.

Not sure how you signed up? Have you seen the unmistakable Platte installation process? View a harmless video of the sign-up process on Platte Media’s website.

According to today’s Office of Fair Trading press release, Micro Bill Systems (MBS) “co-operated with OFT requests to review the clarity of the sign up process consumers go through to access to its web site content, the fairness of its terms and conditions of use, and its automated billing process.” The OFT now believes that “they [MBS] achieve the right balance between protecting consumer interests without stifling innovation in the ‘on-line’ market place.”

I no longer need this feedback: I’m interested in hearing from people who have encountered the new popup bills (Your Platte Subscription). What do you think of this billing method? Did you know what you were doing when you signed up? Or do you feel caught out? Did another member of your family sign up and you now have to pay the bill? DO YOU FEEL HARASSED? – The mbsvictims.org.uk forum is drawing attention to a recent legal ruling on a case brought against British Gas.

ARE YOU FROM NORWAY? – 13 January 2009: Platte has a new website (thexxxcollection.com) aimed at Norwegian internet users. 698 Kr per 90 days. All of the information below is for UK visitors but if I find out the Norwegian equivalent of Trading Standards (anyone know?), I will provide a link. There are two possible helpful links for Norwegians – The Consumer Ombudsman and the Norwegian Consumer Council. West Yorkshire Trading Standards suggests that Norwegian users are directed to the UK European Consumer Centre.

WHICH ORGANISATIONS CAN HELP – The following organisations have received a large number of enquiries and complaints about Platte: Trading Standards, Consumer Direct, The Office of Fair Trading. Platte Media also has a frequently asked questions page. Here is a page of all these organisations’ contact addresses for your convenience including a link to the Platte demonstration sign-up videos.

WHO TO WRITE TO – If you are upset by your experiences of Platte, then writing to Trading Standards, the Office of Fair Trading, and your Member of Parliament will help make your views known.  January 2009: The mbsvictims forum (started when pop up billing was introduced by Micro Bill Systems in 2007) has now begun a new letter writing campaign. There are some sample letters to assist you.

COLLECTION AGENTS – I am receiving reports (Nov. 2008) of letters (Re: Outstanding Balance) which state “Failure to make the above payment from fourteen days from the date of this letter will result in us forwarding this debt onto Oriel our appointed collection agents and will incur an additional £25.00 administration fee“. 20 November: I have received several reports and copies of letters from Oriel Collections Ltd demanding payment. Nobody has reported Oriel taking any action beyond this. If anyone receives letters in January 2009 from Oriel Collections Ltd, please let me know (my e-mail address top right) – more reports have been received this month (March 2009).

PLATTE SOFTWARE REMOVAL – No direct links to manual Platte removal methods (or any detailed ‘how to’ descriptions) will be published here for legal reasons. The mbsvictims.org.uk forum does discuss these removal methods (free) but as a journalist I’m not getting into that topic. I cannot help anyone remove Platte manually and you will have to search for the answers. There is a report (8 Dec 2008) in the Inquirer that Prevx Edge (PC security software) will flag applications such as Platte as “precautionary removals” if detected. Prevx told me that “If you install Prevx Edge and pay the £19.95, it will remove Platte from the machine if you choose to do so.” Important note: You may have contractual obligations to Platte if you knowingly downloaded the Platte software. For more background on the legal issues about removal, read Legal wrangles over porn billing software (31 May 2007, The Guardian) which was about Micro Bill Systems (later acquired by Platte International).

HOW DID PLATTE GET MY HOME ADDRESS? – If you have received a letter from Platte and you didn’t give Platte your home address or postcode, please get in touch. There are unproven suggestions that Platte has been using IP addresses to obtain this personal information from internet service providers.

I covered this issue and Platte’s denial in Will Platte be beached by VAT? (9 October 2008 The Guardian). But I am still receiving reports from people (latest report: 20 Octobe 2008). Please also read Platte International’s response on ISPs and home addresses as a comment below (14 October 2008) before you contact me.

COUNTY COURT CLAIM – If you have received a Platte letter and a page of ‘pre-submission information’ mentioning the possibility of a county court claim (Northampton County Court) for an outstanding debt, I’d like to hear from you (25 November 2008: I think this issue has now ceased)

Letters referring to court action are still being reported no longer being reported. Nobody contacted me to say they are actually being taken to court.

PLATTE SUBSCRIPTION CHARGES – There have been recent changes (noted in Nov 2008). Instead of £29.99 and £28.99 for 30 days subscription (two sample porn sites) it seems Platte has revised its charges. On the two sites I have checked, I’m seeing “The best value adult website at £49.99 for 90 days access” and “You will be billed at GBP 49.99 per 90 days of subscription”.

27 January 2009: Due to many e-mails about Platte each day, I now expect only to hear from people (by e-mail) who have read ALL the information here carefully and have something NEW to say. You are welcome to leave comments on this page for others to read and reply to.  As a journalist, I’m continuing to track the issues being experienced  – and that’s why I’m most interested in any NEW developments.

Please look at the above information as it will answer nearly all your questions. If you want to air your problem, seek explanations, or make a complaint, please may I suggest you contact Trading Standards in the first instance.     Michael,
    Just to give you an update. I sent a letter to Oriel 1st class on 3rd April explaining that I was in dispute with Platte and would not be paying the £54.99 fee. I received another letter from Oriel yesterday 7th April which was identical to the first letter. Should I just ignore this second letter or reply again?


    [Have a look at the Office of Fair Trading's debt collection guidance document (pdf). See section 2.6h: "ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment". It would be worth you looking through this document as this is just one example of "unfair practices". Do you think that Oriel sending you an identical letter is in breach of the OFT's guidance? But in case your first letter went astray, you might consider sending a copy letter recorded delivery (signed for). -Michael.]

    I just saw Steve’s post about Oriel. I was in the same position. When Oriel contacted me demanding me to pay £54.99 within 7 days, I wrote to Adrian Stalley and stated the whole story of how I was getting these pop-ups out of the blue. I sent the letter in the last week of March 2009 first class. I heard nothing since. It sounds possible that Steve’s letter went astray?
    Steve, perhaps you could write another stating you sent them a letter on 3rd April and asking if they received it, and tell them why you feel you are being asked to pay for something you never used. If they ignore you again, then perhaps contact the Office of Fair Trading about this and showing them the letters you sent.

    hello micheal,i recieved a letter from oriel on the 2/4/09 from oriel demanding £54.99.this supposedly for sevices to platte media from last year.i telephoned them up immediately to tell them i have never heard of platte media let alone subscribed to them.they told me of two films that had been watched from this address,and that someone else must of accessed them.this is impossible as i live on my own.they gave me seven days to seek legal advice.i will not pay them a penny.some time last year the pop ups started to appear,i could not get rid of them.as i am not very clued up on my p.c ,i took my laptop to a shop to have it wiped off at a cost of £40.i am so glad i looked up your site.

    and yet again platte media is at it again.i went for the free trail for films and i tried to cancell it .and to my surprise i missed the deadlin 1.5hrs yes 1.5hrs now they have got my adress and oriel are now sending me bills for£74.99.what is the best course off action for me to take.yours faithfully paul kingdon.


    [I suggest you write to Oriel setting out the exact details of your dispute with Platte. Ask for the records showing date/time of registration and website accesses. I'm also thinking here of Porn billing firm lures customers with promises of Hollywood movies. Or was there a technical problem that prevented you cancelling?     hi everyone,
    recieved a letter from oriel on the 15/04/09, that payment was due immediately of £74.99 payment within 7 days, I have rang oriel and spoke to a nice man called simon who listened to my complaint and why I was not going to pay this bill, he said they would have to get in touch with platte and get back to me.
    So here i am waiting again.. NOT to pay platte.

    Ireceived a letter from Oriel yeaterday for the amount of £74 99 it was originally £49 99 Itelephoned and spoke to a man called Simon and told him that there was no way I was going to pay as i had not subscribed he said he would look into it and try to get it cancelled.Iwill keep you informed of the outcome

    today 17/04/09 I have done as advised i have emialed comsumer direct & trading standards etc.
    I have also put it in writing to oriel the dispute with platte and made it plain that i am not paying for something i have never had & never wanted & posted Recorded delivery. will keep you informed.

    hello everyone
    my dad has fallen victim to this scam a popup appeared on the computer demanding a payment of £49.99 in a panic he phoned platte international and unfortunutly gave them his details. I have contacted trading standards who said to write a letter to platte refusing to pay the amount. My dad has since received a letter from oriel demanding a payment of £74.99 we contacted oriel who advised us to get in contact with our service provider which i have done but unfortunutly they cannot back track to the date that the site was installed i have also contacted the police who advised me to write them another letter saying i will not be paying the amount. any other advise will be much appreciated.

    Hi everyone more info for you from Comsumer direct….First I would clarify that only a court could order you to pay a debt. To get such an order the claimant (the collection agency) must provide proof that you owe a debt.

    West Yorkshire Trading Standards have looked into this trader’s activities and found that the billing software is downloaded to the computer following a 7 step process (which includes being made aware of the charges, terms & conditions and requiring the input of various details such as date of birth) by consent of the person operating the computer.

    Following discussions with Platte Media West Yorkshire Trading Standards Service advises consumers with billing disputes to have regard to the following points made by the company:

    1. The billing software has been downloaded to your computer by consent of the person operating the computer (this is is a 7 step process requiring input of date of birth and a personal 4 digit code).

    2. If you have not subscribed to the service as described in 1 has anyone else with access to your computer done so? Ultimately, the person who is responsible for access to the internet (e.g. the person with the internet account) would be liable for payment of the bill.

    3. If you are unsure whether you or someone else with access to your computer have subscribed to a Platte Media service further information can be obtained from the Company by ringing 0845 017 8386 [lines open Mon- Fri 8-20:00; Sat & Sun 11-17:00; all calls charged at local rates.] and quoting your eight digit Platte User ID which appears on your billing window. More detailed information on the subscription process is available at plattemedia.com.

    If following discussion with the trader you still wish to dispute the bill, you should send the trader and the debt collection agency a recorded delivery letter, outlining everything to date, and giving a deadline to resolve the matter within a set period of time (i.e. 14 days). Make it very clear what you are claiming from the trader. It is also worth retaining copies of everything sent, for your records.

    Absolutely great news… this is the official response from Oriel as posted by Matt_d on the mbs/platte victims forum.

    “Due to the fact that Platte International Limited are ceasing to trade in the uk we are ceasing our collections of legitimate debts over the coming month”.

    “Our current process insures only letters with name and address details go out and no letters will be sent addressed to “the computer owner”.

    Hi. i get a bill 29.99euro from platte service and i get panic to and pay the bill, now i have big problem from this f[******] company. how can i do??? i want them go to hell. Can everyone of us go to police? or what can we do??? I want to now because i get bill over 25 everyday from them but anyway i have pay the bill…. please somebody can help me????

    Have received a letter from Oriel today 30/04/2009 demanding £54.99 as they have been appointed by Platte International to collect this sum. A year ago I was pestered for £29.99 for supposedly visiting their site, I have never signed or subscribed or ordered any goods or any software of any description from this company.
    I have been instructed to call Oriel 08452261816 to pay this amount. We are two mid seventies pensioners and are finding this most distressing, despite phone calls to complain we are still being pestered by this company.

    Same shit here. I’m sorry I didn’t google Platte and knew this information before sending them an e-mail. Now they have my name, and I’m one of few with that name in Norway (and the rest of the world). I accused them of fraud, and said that I had no intentions to pay the bill. After my e-mail the invoice suddenly appeared with the due payment of NOK 0,-!!! for a couple of days. Then I got an answer – I don’t recall the details, but Platte was going to persue the debt. I then sent a threatening answer saying that this is illegal according to Norwegian Law, that I was not afraid to take this further, and that (luckily) I work for one of the largest corporate law firms in Norway (which is true). They never answered. But the days and weeks followed with changing invoices of NOK 0,- and NOK 6-700,- something. The last few days a “first warning”-text (don’t know the English term, it’s in Norwegian) has appeared (on both invoices!!). I kick myself for not having googled Platte earlier. Tonight I have deleted their access through helpful programs. But I’m still worried by the fact that they now have my full name. That’s why I don’t want to leave it here. I’m sure that also Platte visits this page… Good luck to you all! Regards from Norway :-)

    Kent, There have been reports of it being taken up with the police, but they have, to date, taken no action. I think the problem is that this is something that is outside their experience, and as the OFT in the UK have allowed them to continue trading, this will have made the police reluctant to intervene.

    It’s all something of a vicious circle, really. And there’s a lot of suspicion, I’m sure, on the part of the authorities because of the subject matter of the Platte websites.

    TO:- Michael Pollitt I have read all your above column, and find that the letter from Bill Mountain (is that his real name?) covers the siuation perfectly ie we are in our seventies and are frantic with worry over this Platte Media demand. Initially we received a demand for £49.99 dated 27/11/2008 when I stumbled on this website ; to rid myself of this Platte logo etc I put my computer back to factory setting and did not use the internet again on it.
    In February this year 2010 I was inundated with “INTERNATIONAL” – telephone calls which I ignored. I worried this out and realised it might have a connection with the original Platte invoice for £49.99 as i had not had any postal contact . I don’t know what to do. please help
